How to respond to
a “Notification of Provisional Refusal”
issued by the JPO under the Madrid System
A Japan Paper Company, "Daio Paper Corporation", published that they had settled with the Chinese trader who had imported their disposable diapers on a parallel import basis without their permission on July 24. The condition is not to import their disposable diapers on a parallel import basis hereafter.
Daio appealed the trader to Chinese Court on Trademark Infringement in May, 2014.
The trader has accepted discarding the goods which the Chinese Custom had seized.
And Daio confirmed the discard in the presence.
In China, Japanese disposal diapers are sold more expensive than in Japan.
Thus, there are many troubles by parallel importers.
Daio had judged that if they take no actions, the brand value will be damaged, and took litigation.
